1. Introduction

1.1 www.lalatteria.co.uk (the “Website”) is operated by Samia Dairy Limited, trading under La Latteria (“we”, “us” and “our”). This is a limited company registered in England with company number 9427970 and VAT number GB 215 5142 41. Our registered office is New Derwent House 69-73 Thoebalds Road London WC1X 8TA.

1.2 By accessing this website you agree to these terms and conditions. If you do not agree to them you may not use and access this website. Please read the terms and conditions carefully before placing any orders on www.lalatteria.co.uk.

1.3. These terms cover the website and related services in the United Kingdom and were most recently updated on 15 February 2016.

2. Use of Website

2.1. The Website and related services (including any applications which allow you to buy our products from us on mobile devices) (the “Services”) are made available to you in accordance with the following Terms of Use, and any other rules posted on our websites (“Terms”). Please read the Terms carefully before placing any orders, we recommend you should keep a copy of the Terms for future reference.

2.2 Please note that these Terms do not affect your statutory rights as a Consumer. For more information about your rights contact your local Citizens Advice Bureau or Trading Standards Bureau.

2.3. You agree that the information that you provide when you register is true, accurate, current, and complete in all respects. Should any of your registration information change, please notify us immediately. We may also change registration requirements from time to time.

2.4. We may change, withdraw, or suspend access to the Services (in whole or in part and permanently or temporarily) with or without notice and with no liability to you.

2.5. The Services may include links to other websites or resources. We have no control over the content of these websites and are not liable in any way for their content.

2.6. Any material that you upload to the Website or which you send to us via any other medium (including all social media) will be considered non-confidential, non-proprietary and we will have the right to use, copy, distribute and disclose to third parties such material for any purpose. We also have the right to disclose your identity to any third party who claims that such material infringes their intellectual property rights or their right to privacy.

2.7 We will not be responsible or liable to you or any third party for the content or accuracy of any materials posted by you or any other user of the Services and you agree to be responsible to us for and indemnity us and keep us indemnified against all costs, damages, expenses, losses and liabilities incurred and/or suffered by us as a result of any claim in respect of your use of the Services.

2.8 We have the right to remove any material or posting you make on the Website at our sole discretion.

3. Orders

3.1 All purchases made on this web site are governed by these Terms and Conditions at any time although the Terms and Conditions governing any given purchase will be those in effect at the date of your order. If you order goods after we have published the changes you will be bound by those changes. You should check prior to each order to ensure that you understand the precise terms and conditions applicable to your purchase. We endeavor to display the date and time when these Terms and Conditions were most recently updated.

3.2. Features and price of the products sold on the Website (hereinafter, “Product” or “Products”) are shown on the page relevant to each Product.

3.3. For purchasing the Products the Customer shall fill in and send the order form in electronic format, following the instructions on the Website. The Customer shall add the Product to the “Basket” and, after reading the General Terms and Conditions and the Privacy Policy and confirming their acceptance, he/she shall insert the shipping and billing data (if any), select the desired method of payment and confirm the order.

3.4. By submitting an order from the Website, which has the value of a contractual offer, You agree that your order is an offer to purchase the product(s) listed in your order to us on the Terms. You agree that an order is engaging in a contract with Samia Dairy Limited (trading under La Latteria).

3.5. All orders are subject to our acceptance and availability. The agreement entered into between Samia Dairy Ltd and the Customer shall be considered as concluded once the order has been accepted by La Latteria. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the email address you have provided to us.

3.6. We will inform you if we are unable to fulfill your order. We may choose not to accept your order in our discretion for any reason without liability to you. Examples of occasions we may not accept your order are: that we are unable to obtain authorisation for payment; the item ordered is out of stock; the item ordered does not satisfy our quality control standards and is withdrawn; or that you do not meet the eligibility criteria set out within the Terms.

3.7. We will store a record of your transactions for a minimum of one year.

4. Prices

4.1 Prices shown on the Website are in Pounds and zero VAT. Prices do not include delivery charges.

4.2 The price of the goods will be as quoted on the web site at the time you confirm your order (usually by clicking the “checkout” button) subject only to any inadvertent technical error for which we will not be liable. If you subsequently amend your order, the prices charged will be those applicable to the amended item(s)at the time that the amended order is confirmed. Please note that as promotions are offered for a limited period of time subsequent amendments to your order may mean that certain promotions are no longer being offered.

4.3 The price of the Products does not include a charge for delivery. For orders above £50, no delivery charges will apply.  For orders below £50, a variable delivery charge will apply. Check our delivery rates for more information. We will not charge you any additional delivery charge should you live within the London congestion charging zone. A minimum order of £15 is required (not including delivery cost). For delivery outside the Central London area please contact us on info@lalatteria.co.uk.

5. Payment

5.1. Payment can be made by debit, credit cards or PayPal. No cash payment will be accepted. Payment will be debited and cleared from your account upon completion of the order process on the Website.

5.2 The debit, credit and charge cards accepted by us are those listed on the web site on the date on which your order is placed.

5.3 You can also use PayPal. When you select the PayPal option at checkout, you will be directed to the PayPal site to ‘Log In’ to your PayPal account and review the total amount to pay before clicking ‘Pay Now’. Once you click ‘Pay Now’ your transaction is complete and you will be returned to www.lalatteria.co.uk.

5.4. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

5.5 To help ensure that your shopping experience is safe and secure, we use state of the art security systems to encrypt your payment details, making it virtually impossible for the to be read over the internet.

5.6. The Website does not store the credit card number of the Customer, but thanks to the secure communication system of the bank of reference, from the second purchase, the Customer who so wishes – through the selection of the appropriate option – shall be able to proceed with the purchase without re-entering his/her data.<

5.7 Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

6. Transport and Delivery

6.1. We deliver Mon-Fridays, excluding public holiday. Saturday deliveries coming soon.

6.2. One of our delivery partners will deliver your purchases to you using a packaging system that keeps the product at a controlled temperature from the moment it leaves our dairy to the moment it reaches you.

6.3 Delivery will be made to the address specified by you when you register on the website. You have the ability to change this address, during the check out, should you need the delivery made to a different address (ex. your office). We reserve the right to restrict deliveries in certain areas.

6.4 We take special care to endeavour that deliveries are made right after production to ensure the highest level of freshness. It is your responsibility to ensure that an appropriate person is available at the delivery address. Please indicate alternative arrangements (e.g. leave with a neighbor or leave outside of the door, etc) at the time of the order. If no one is home, we will instruct the courier to leave the parcel in a safe place. If no one is home and the parcel is left in a safe place, then this the delivery is considered to be fulfilled.

6.5. If you discover that any goods are missing or damaged, you must notify us immediately.
Risk of damage or loss to the goods (including deterioration of fresh foods) passes to you on delivery or if delivery is attempted but you are not present to accept delivery or wrongfully refuse delivery or if an incorrect address is supplied.

6.6. Please note adverse weather conditions or other events outside of our reasonable control may result in the occasional late or cancelled delivery. If that is the case we will endeavour to contact you as soon as we are able to in order to reschedule your delivery time and date. In any event our liability to you will be limited to the price of goods not delivered and the cost of delivery.

7. Defective Goods

7.1 We guarantee the quality of our goods. You must inspect the goods and notify us promptly of any dissatisfaction with your order. We will promptly and fully refund the cost of any goods that do not meet with your reasonable satisfaction. We will arrange with you for the goods to be returned to us.

7.2 Subject to clause 8.1 below, we will not accept any further claims for loss from or in connection with the supply of faulty goods, whether direct, indirect, consequential or otherwise, howsoever arising.

8. Amendment of orders and cancellation rights

8.1. At any time up to 4pm on the day before your order is to be delivered you may change your mind about purchasing the goods and withdraw or change your order. There is no charge for doing this.

8.2 Should you wish to cancel your order outside the period set out in paragraph 8.1 we shall be entitled to charge you in full for an amount equal to the cost of the perishable items contained in your order and the cost of delivery.

9. Warranty and Liability

9.1. Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, neither will any of these terms restrict any of your statutory rights.

9.2 We will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war.

9.3 Other than as set out in clause 9.1, our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.

10. Privacy

10.1. We respect your privacy. Personal information collected from you is subject to our privacy policy. The personal information that you give us is held with care and security. We do not sell, rent or transfer this information to third parties for their marketing purposes unless you agree otherwise.

10.2. At the time of your registration you will receive a password. Please keep this secret, as you are entirely responsible if you do not maintain the confidentiality of your password. You are entirely responsible for all orders placed with us or information given to us under your email address in combination with your password. You must immediately notify us of any unauthorised use of your email address and/or password or any breach of security known to you.

12. Special Offers Promotions and Competitions

12.1 From time to time, and in our complete discretion, purchases of goods may be subject to special offers. In the event that such a special offer applies to your purchase, the terms of such special offer shall be subject to these Terms and Conditions. If there is any conflict between the terms of a special offer and these Terms and Conditions, these Terms and Conditions shall prevail unless specifically excluded.

12.2 We may change the terms of special offers, or withdraw them altogether, at any time and without prior notice.

12.3 We reserve the right to offer in our complete discretion different customers different special offers, promotions and the ability to enter different competitions.

13. General

13.1. These T&Cs constitute the entire agreement between you and us in connection with the use of this website. Any failure by us to exercise or enforce any right or provision of these T&Cs shall not constitute a waiver of such right or provision. If any part of this agreement is deemed ineffective for any reason, the remainder shall continue in full force. A person who is not a party to this agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.

14. Law and jurisdiction

14.1 This contract shall be governed by English law and any disputes will be decided only by the English courts.
